Firm History, Background, & Philosophy
Hamstead & Associates is a well-established general practice law firm which is comprised of two attorneys and two paralegals. Lead attorney, Braun Hamstead, has been practicing law since 1987 and has a wide and varied plethora of experience. He began his career as Prosecutor of Jefferson County and then opened his own solo practice. He is a well seasoned and successful litigator. Mr. Hamstead also has experience serving as mediator and also as an adjunct professor of Environmental Law. The firm also benefits from the insights and recent academic experience of Associate Counsel, Andrew Pahl, Esquire, a recent law school graduate. Our Firm is able to provide a wide variety of services, ranging from the preparation of a simple Will to Supreme Court trial litigation. We handle Wills & Estates; Business Law; Corporate formation and management; HOA formation, collections and management; Real Estate closings and litigation; Government law; Administrative Law; Family Law; Employment Law; Land Use; and other general litigation related matters.
It is widely known that most legal disputes are resolved through negotiation. Courts routinely mandate that most cases be mediated to see if they can be resolved without a trial. The team at Hamstead & Associates is trained and skilled in negotiation. Mr. Hamstead has attended the West Virginia State Bar approved mediation training, as well as other mediation seminars. The first step is to professionally interact with clients’ adversaries to resolve matters as quickly and effectively as possible. Critical to successful negotiation is the ability to make good on the strong points of the case. When negotiation attempts fail, Hamstead & Associates will not hesitate to bring meritorious claims before the court and jury with professional, zealous advocacy when necessary to properly advance client interests.
The Staff at Hamstead & Associates provides personal service to individuals as well as corporate entities. A number of our clients have relied on us for many years for assistance with their business transactions, employee matters, as well as personal matters. We are there for all your needs, great and small. We value people and strive to build long lasting, mutually respectful relationships with our clients.
Scope of Legal Services
The firm offers a unique merger of real estate law and real estate litigation knowledge and experience. It also provides a broad base of legal services to individuals and businesses, ranging from the simple writing of Wills to full-blown litigation (with jury). Braun Hamstead began the practice of law as a partime Assistant Prosecuting Attorney and as a real estate closing attorney. He was elected Prosecuting Attorney for Jefferson County, West Virginia, in 1980. During his four year term as State's attorney he successfully prosecuted a cult leader for child abuse, prosecuted a defense attorney who tampered with the State's witnesses, and he was even once called upon to confront a Circuit Court Judge who improperly tampered with a grand jury.*
*State ex rel Hamstead v. Dostert, 173 W. Va. 133, 313 S.E.2d 409 (1984), involved the entry of a writ of prohibition against the circuit court judge precluding him from holding Mr. Hamstead in contempt of Court where the trial judge had exceeded the scope of his authority. "Today's case is an example of a prosecutor exercising sound professional judgment and integrity in the face of considerable personal duress," quoting concurring opinion of Justice Neely, Ibid at pg. 149; 425; 50.
